Dear Judge Mazzone,
I am writing to confirm our conversation of October 16, 1997.
I understand that on August 18, 1997 the FDIC has extended a settlement offer to my parents for One Million Dollars. This sum has gone up over the last three years from a 1994 settlement offer of $640,000.
The offer as I heard you state in the October 15 meeting with Bishop Dyer and Senator Tarr was that the FDIC will agree to come to the table one last time if and only if my parents agree to pay them money, a fee that would begin from their last written offer of One Million Dollars.
I am grateful and happy to be of service in this mediation process however I am concerned that your use of me as an object to help settle this case is inappropriate due to the fact that you are not or con not for some reason do the same on the side of the FDIC. My understanding is that you are only able to discuss the case with Joe Shea despite our pleas for an unbiased party to come forward on behalf of the FDIC. In addition to this, the FDIC stated in our September 12, 1997 meeting that Mr. Joe Shea and Mr. Palladino were NOT the decision makers for the FDIC even though we all agreed to bring the decision makers to the table. Not only are the decision makers not at the table yet, we still do not know who the decision makers are and my understanding from you is that you are not permitted to speak with anyone other than Mr. Shea. If I am the only person being leaned on to persuade my parents and you are unable to speak with anyone other than Mr. Shea then how can we call this process mediation?
Lastly, you chose two independent fact finders Bishop Mark Dyer and Senator Bruce Tarr which you stated were to evaluate the facts and present their positions to the FDIC. It is my understanding that you believed that they supported you in your assessment to pay the FDIC a significant sum of money to get them out of our lives in order to end the pain and suffering. As you have requested, if they did not agree with you that they should contact you and I understand that they have or are in the process of contacting you agreeing that the pain and suffering
should end but not in the form of us paying out a large sum of money. With these letters, will you 1.) Determine who the FDIC decision makers are and 2.) send their letters to these unidentified individuals.
I recognize that we are all in a very difficult position and I mean no offense by my comments. I beg you to consider these points as you will hopefully be able to speak with the decision makers not Mr. Shea and use them also as objects of persuasion on the side of the FDIC. In the meantime I will do what you have requested of me which is to act as "the messenger." Let me reiterate that these are my opinions and I DO NOT have nor have I EVER had power of attorney to make the decision to exchange money or not. I will speak with my parents and they will contact you.
