Dear Faith:

Reading your letter again and trying to take every step I can to see that this matter is resolved, I have discussed the matter extensively with representatives from the FDIC. The specific answers to your question are the following:

  1. If the question is whether the FDIC will drop all proceedings against the Sweeneys and/or compensate the Sweeneys in money damages, that decision must be made in Washington, D. C. by the Board of Governors, and is a process in which I am not involved. Your earlier efforts through political and direct approaches give you a better position to judge the likelihood of success.

  2. If the question is whether the FDIC will settle for an amount of money to be paid by the Sweeneys to the FDIC, Joseph Palladino has a range of authority and is the final decision maker within that range. Since there is no offer before him, he is not being called upon to make any final decision.

My request to you is that you advise me what your final position is regarding questions #1 & #2 above. If the Sweeneys are only interested in #1, I will return the matter to the Court of Appeals as I said in our last meeting. And you are free to pursue this avenue as you choose. If you are interested in #2, I will ask Mr. Palladino and his associate, Lisa Rabins, to appear in my chambers to meet with you and your parents to discuss a final settlement. Neither Mr. Shea nor Linda Thompson will be present.

Please let me know. I will do everything under the authority given to me by the Court of Appeals to continue to attempt to resolve this matter in a mutually agreeable fashion.
