Re:        Mediation Summary

Dear Chairman Hove:

        Please find enclosed our mediation summary presented to Judge Mazzone and the FDIC on September 12, 1997, regarding the unresolved issues of fact and law between the Sweeneys and the FDIC.

        Would you please prepare a written response to our mediation summary, addressing the issues of fact and law which have been fully documented for you, and submit it to Judge Mazzone at the earliest possible time.

        If the mediation process is to be successful, it is only fair that both sides be held accountable to the same set of standards. Otherwise the process will -- in the very least -- have the appearance of prejudicial treatment. The FDIC must show good faith efforts by presenting their written response to the Sweeneys and the mediator, Judge Mazzone.

        We look forward to meeting with the appropriate Washington officials at future mediation meetings who have the authority to address the issues of fact and law and make settlement decisions. This will provide both parties with the opportunity to gain settlement of this dispute peacefully and fairly. Thank you for your consideration.
