Dear Judge Mazzone:

We are in receipt of your October 29, 1997 fax.

Yesterday we met with Senator Tarr and will be speaking again with Bishop Dyer.

We are pleased that you will "gladly forward any statement " that they provide you to the FDIC concerning the extensive information presented in our mediation summary and their positions and recommendations to you. It is our understanding that they will be preparing such a statement and will be contacting you directly.

We are also pleased that you will arrange a meeting for Senator Tarr and the Bishop with the principals of the FDIC in Washington, DC as Bishop Dyer requested. A face to face meeting between the real FDIC decision makers and objective, independent fact finders cannot help but be productive and help you and all of us in these mediation efforts.

We want to reiterate our desire to settle this matter quickly and equitably through your office and efforts in mediation.
